TicketCover™premium Terms and Conditions

 

SECTION 1

If you or a member of your party, are ubable to attend or are caused to arrive late thereby being unable to take up or attend a booked performance as a direct result of the reasons mentioned bellowed, you may be eligible for a reimbursement for the total purchase price of your ticket (including itemised postage and service fees that were enumerated to you at the time of sale provided none of the conditions in Section 3 apply):

 

1. Your illness, accidental injury or death;

2. Death of an immediate family member (child, spouse, civil partner or parent);

3. Accidental damage, breakdown or failure of the transport in which you are travelling to the event;

4. Strikes, riots, civil commotion or martial law;

5. Restricted access to the venue caused by flood, fire, explosion, or through the act of a constituted authority to protect Public Health and Safety;

6. Being unable to attend the event because of adverse weather, including snow, fog, frost or storm; or

7. Cancellation, abandonment, postponement or relocation of the event which is: the sole and direct result of a cause not otherwise excluded in Section 3 below and is beyond the control of yourself (including any member of your party), Seatwave and/or the artist, act, celebrity or team playing.

 

In the event that you wish to apply for a reimbursement for the cost of your ticket due to the reasons referred to above, notify Hyperion Claims Specialist Limited as soon as practically possible and in any circumstances within 3 working days  of the incident which leads to a claim being made under the TicketCover™premium scheme by calling 020 7236 8888 (Fax no: 020 7236 8898).

You will need to provide certain evidence to support your request - information which may be required is listed below and will be requested on registration of the claim.

 

 

SECTION 2

 

Supporting Documentation

 

For all instances the original unused tickets must be submitted within 7 days of the incident that leads to your claim being made. If tickets have not been issued yet, you will have to assign your rights to the tickets to the insurer. In support of your claim you may have to produce one of the following:

1. A doctor's note or report for accident or illness claims or a death certificate for death claims.

2. Death Certificate or similar

3. Confirmation letter from the court

4. Letter from the Police, Fire Brigade or Household insurer

5. Confirmation from rescue/ repair service or public transport provider. For the breakdown of a private vehicle, where no rescue or repair service applies, a copy garage repair bill or parts receipt or in the case of a motor accident claim, confirmation from the vehicle motor insurers, vehicle repairers or police.

6. Confirmation from AA Roadwatch or similar. Transport Police if delayed in Motorway.

7. Police or hospital report to confirm incident

8. The original unused ticket or assignment of rights to the non-issued tickets

9. Any reasonable additional evidence which the insurer may request

 

 

SECTION 3

 

We will not consider reimbursement of a claim if such claim results from  the following circumstances:

1. Any contractual dispute or breach of the Seatwave's User Agreement.

2. A lack of care, diligence or prudent behaviour, the results of which would increase the risk, and/or likelihood of a loss hereunder by you.

3. Failing to observe and comply with the requirements of any law, ordinance, court or regulatory body of whatever jurisdiction.

4. Any fraud, misrepresentation or concealment

5. Actual or threatened War, invasion, act of foreign enemies, hostilities (whether war declared or not), civil war, rebellion, revolution, insurrection, military or usurped power, confiscation, nationalisation, requisition or destruction of or damage to property by or under order of any government or public or local authority.

6. Failure, in the event of bodily injury or illness, to consult a duly qualified medical practitioner and comply with the medical advice given thus causing a loss in whole or part under this insurance.

7. Death, bodily injury or illness directly or indirectly caused by or resulting from suicide or intentional self- injury or criminal act by you and any condition which existed prior to the start of your TicketCover™premium insurance.

8. Non appearance by any act, artist, performer, celebrity or team.

9. Any loss directly or indirectly caused by or arising out of or contributed to by or resulting from, any influenza variant or communicable disease which prior to or simultaneously with the loss arising, is declared an epidemic or pandemic by the World Health Organisation and/or Severe Acute Respiratory Syndrome (SARS) and/or Atypical Pneumonia and/or Avian Flu and/or any threat or fear of any of the above (whether actual or perceived).

10. Any act of or threat of or fear of Terrorism (whether actual or perceived) regardless of any other cause or event contributing concurrently or in any other sequence to the loss.

11. Any loss of or no play caused by any weather condition which reduces or prevents play at any outdoor sporting event on the day itself.

12. Any music concert where the performing area is not fully and prudently covered with a roof and three sides.

Unless we agree otherwise:

The language of the document and all communications relating to it will be English; and all aspects of the document, including negotiation and performance, are subject to English law and the jurisdiction of English courts.
